Galleon Fine Vines Inc. (hereinafter “Galleon”, “we”, “us”, “our”) operates this Site www.galleon.wine, www.galleon.vin, www.galleonwines.ca (the “Site”). Our objective is to provide you with the most convenient fine wines shopping experience.
The conditions set forth below govern all orders placed by you via the Site and as such constitute a contract between you and Galleon (the “Terms”). Please read these conditions carefully before you place an order via the Site.
The Terms apply to any purchase and any order you may place via the Site. By placing an order for our products, you agree to be bound by, and comply with, the Terms. Should you wish not to be bound by the Terms, we invite you not to place an order.
You can verify directly on the Site whether the desired products are available, however, such availability information is synchronized with our inventory on a weekly basis, as such, the information provided on the Site may not be accurate at all times. We will inform you of such availability upon validating your order.
Galleon purports to provide precise descriptions of its products but cannot warrant the accuracy, reliability, up-to-datedness or integrity of the descriptions displayed on the Site. Moreover, pictures of the products appearing on the Site are provided for information only.
2.1 Acceptation of orders
Galleon will send you a confirmation email upon reception of your order. All orders placed via the Site remain subject to acceptation by Galleon. Prior to accepting your order, we will, amongst other things, validate the availability of the products you ordered as well as verify that there were no price errors with respect to such products. Such validations normally take up to five (5) business days. If we accept your order, you will receive a confirmation to that effect. Should we refuse to process your order, or should we decide, at our sole discretion, to cancel your order, we will inform you of such decision and as the case may be, not to invoice you or to refund you any amount collected according to the payment method used.
2.2 Changes and mistakes
Subject to applicable laws, Galleon reserves its right to (i) change the price of products advertised or offered for sale on the Site, as well as any promotional offer, at any time and without prior notice, and without engaging our liability towards you or anyone else; (ii) limit the quantities sold or offered for sale; and (iii) cancel an order, put an end to it or refuse to process it (including an order previously accepted by us), should we realise that the price or any other specification of the product is incorrect or for any other reason.
Should we ever realise that the price of a product displayed on the Site and ordered by you is incorrect, and insofar as this product is available, we will offer you the possibility to order it at the corrected price.
2.3 Change or cancellation of an order
Should you wish to cancel an order you have placed through the Site, please contact our customer service.
Price and payment terms
2.4.1 For Consumers
The price for our products is shown in Canadian dollars. All fees, including those arising from shipping and delivery, as well as applicable sales taxes, are not included. Galleon reserves the right to modify the price of products offered on the Site at any time and without prior notice.
2.4.2 For Licensees
For licensees, the price for our products is shown in Canadian dollars and includes sales taxes. All fees, including those arising from shipping and delivery are note included.
2.5 Payment Terms
2.5.1 Consumer, Home Delivery.
Should you be a consumer (someone who places its order for its personal consumption) and should you select home delivery (as opposed to SAQ store delivery), you will be required to pay all purchase price of the product(s), Galleon service fees and delivery fees by credit card upon placing your orders. Your card will be debited upon placing the order.
2.5.2 Consumer, SAQ Store Delivery.
Should you be a consumer and should you select SAQ delivery (as opposed to home delivery), you will be required to pay Galleon’s service fees by credit card upon placing your order. You will have to pay the purchase price of the product(s) and, the delivery fees, if applicable, upon picking-up your order at your SAQ store.
2.5.3 Licensee, Home Delivery.
Should you be or represent a licensee (i.e. a restaurant or an hotel) and should you select home delivery (as opposed to SAQ store delivery), payment terms will be those granted by Galleon upon conducting credit verifications
2.5.4 Licensee, SAQ Store Delivery.
Should you be or represent a licensee and should you select SAQ delivery (as opposed to home delivery), you will be required to pay Galleon’s service fees by credit card upon placing your order. You will have to pay the products and, the delivery fees, if applicable, upon picking-up your order at your SAQ store.
2.6 Sales Receipt
Should you select home delivery, the sales receipt for your purchases will be automatically generated by the Site and will be sent to you by email once Galleon has processed your order. Should you select SAQ Store Delivery, the Site will generate a sales receipt for the service fees. The sales receipt for products and delivery, if applicable, will be generated by the SAQ upon picking-up your order. In either case, such sales receipts will be deemed to be an integral part of the Terms.
2.7 Secured Payment Transactions
Credit card payment is done using encrypted mode according to SSL (Secure Socket Layers) protocol. At no time will Galleon have access to your credit card information. Your banking information is only processed by Stripe and Paypal, our suppliers, and is subject to their respective privacy policies (Stripe: https://stripe.com/ca/privacy/ Paypal: https://www.paypal.com/ca/webapps/mpp/ua/privacy-full?locale.x=en_CA). However, no safety mechanism is perfect and you should know that there always exists some risk that personal data you transmit to Galleon might leak without your consent and through no fault of its own. Galleon declines all responsibility in the event that your personal data leaks, except in case of negligence on its part.
3.1 Clearance by SAQ.
As per the laws of the Province of Quebec, The Société des Alcools du Québec (SAQ) has the exclusive right to import alcoholic beverages purchased from any other jurisdictions, including other provinces of Canada. As such, the delivery process begins once the SAQ provides such clearance to Galleon with respect to the products you ordered.
3.2 Email Confirmation.
We will send you a confirmation email upon shipping your order.
We deliver exclusively in Quebec and Ontario through Canada Posts. It is not currently possible to deliver to post office boxes or to addresses outside of Canada, or in some geographical areas of Quebec and Ontario at the moment.
As soon as you receive your order, please inspect the packaging and content of your order for any potential damage that may have occurred during transportation. It is however normal that the packaging may show signs of wear.
3.5 Age Verification
3.5.1 Laws Governing Minors.
Pursuant to section 103.9 of the Act regarding offences relating to alcoholic beverages, minors shall not purchase alcohol for themselves or for someone else. Under section 117.1 of the same Act, an adult may not purchase alcohol for a minor.
By submitting an order through the Site, you represent that you are of legal drinking age in your jurisdiction and that you are not purchasing products for anyone who is not of legal drinking age.
3.5.3 Home Deliveries.
Should you select home delivery the person accepting the delivery will be required to provide a proof of age (valid driver’s licence, passport, valid health insurance card). Should the person accepting the order not be the person who placed the order, such person accepting the order may be obligated to provide a proof of age for the person who placed the order, failure which, the order may not be delivered.
3.5.4 SAQ Store Deliveries.
Should you SAQ store delivery the person picking-up the order will be required to provide a proof of age (valid driver’s licence, passport, valid health insurance card). Should the person picking-up the order not be the person who placed the order, such person accepting the order may be obligated to provide a proof of age for the person who placed the order, failure which, the order may not be released.
4 Refund Policy
Galleon will exchange any defective product purchased through the Site or if we are unable to exchange the product, we will issue a refund.
4.1 Incomplete Order.
We will inform you should it be impossible for us to fulfill the totality of an order you placed through the Site. In such a case, we will refund the purchase price of the product(s) as well as applicable delivery charges for that product (including taxes).
4.2 Defective Products.
You must return the defective product (e.g. corked) or broken bottle to an SAQ Store. Galleon’s refund policy enables you to obtain a refund, or if possible, to exchange the defective product(s) provided that the bottle(s) returned must be at least three-quarters full and bought within the last twelve months. You will be required to provide your sales receipt, failure which we will not exchange or refund your defective product(s).
4.3 Products in Good Conditions.
A product in good condition may not be exchanged or refund under any circumstances.
